This practice direction sets out how to manage planning assessment or controls that conflict with or duplicate matters dealt with or addressed under licensing or regulations of another Act.
The relevant authority must:
- make sure that any controls or conditions set when assessing for planning consent, don’t conflict with, or duplicate regulations or licensing under another Act
- seek the advice of the other body or agency if they are unsure of any conflicts or duplication.
The State Planning Commission issues practice directions to specify procedural requirements in connection the Planning, Development and Infrastructure Act 2016.
For the purposes of section 52(1) of the Planning, Development and Infrastructure Act 2016 this statutory instrument has been certified by the Chief Executive.
