Approval for paid parking

On 3 November 2022, the South Australian Parliament passed the Private Parking Areas (Shopping Centre Parking Areas) Amendment Bill 2022 (the Bill). The Bill amends the Private Parking Areas Act 1986 and seeks to prohibit owners of shopping centres with a gross lettable area of 34,000 square metres or more from charging for parking without the approval of the Minister for Planning (the Minister).

On 10 November 2022, the Governor subsequently proclaimed that the Private Parking Areas (Shopping Centre Parking Areas) Amendment Act 2022 (the Act) would commence from 8 February 2023. This gives any affected shopping centres that wish to charge for parking until 8 February 2023 to obtain approval from the Minister to do so.

A person seeking to obtain the approval of the Minister should complete the below application form and provide to Planning and Land Use Services at PlanSA@sa.gov.au. An applicant will need to provide the following details as part of their application:

  • relevant shopping centre details
  • reasons for seeking approval
  • details on proposed charging structure
  • details on hours of operation (carpark and shopping centre)
  • details on disabled carparks, loading and no standing areas and restricted or permit parking areas (including for staff of the shopping centre)
  • plan of the shopping centre carpark detailing the above
  • details on any consultation already undertaken with the community in relation to the proposal.

In considering an application for approval, the Minister may consult with relevant key stakeholders, including (but not limited to) the local council and any users of the carpark for which an approval is being sought.
